Grandparents keep visitation rights if kids leave Arizona |

Associated Press Feb. 19, 2008 01:57 PM Parents who move their children out of Arizona still have to provide court-ordered visitation time for grandparents and may have to pay hefty fines for contempt if they don't, the state Court of Appeals ruled Tuesday.
The ruling said grandparents still keep their visitation rights even though they don't have the legal right to challenge relocations.
In the case decided Tuesday, a boy's maternal grandparents had raised him for his first seven years before the mother assumed parenting duties. The grandparents then unsuccessfully sought custody but were awarded visitation rights that included at least three weeks each year plus assorted weekends. While in Arizona, the mother, Melody Lynn Munari, was twice found in contempt of court orders on visitation and fined a total of $10,000.
The mother received court permission to move the child to Missouri but was ordered to make him available for visitation. She didn't do that and was ordered to pay $15,300 in fines plus interest and $10,000 in attorneys' fees plus interest.
