By TRIBUNE-REVIEW NEWS SERVICE A Uniontown man has sued the city and two police officers, alleging that they violated his civil rights when he was arrested and shot with a Taser gun in 2006 for an arrest warrant that no longer was valid. Morris Earquhart, 35, alleges in a lawsuit filed Friday in U.S. District Court in Pittsburgh that police officers Dennis Fields and Ray Miller went to his house on Dec. 1, 2006, on a 911 call. When they arrived, Earquhart's wife told them the call was in error and they left. But the officers returned three minutes later and arrested Earquhart on an outstanding warrant. According to the lawsuit, the warrant had been vacated by a court order on Sept. 18, 2006.
Earquhart said when he tried to explain that to the officers, they arrested him and subdued him with electric shocks from the Taser, which he said caused him to lapse into unconsciousness and forced him to lose control of his bladder, according to the suit. The lawsuit alleges that the city failed to properly train its officers in using the Taser. Earquhart was charged in 2001 with a parole violation when he failed to attend a pre-trial conference on charges of resisting arrest and disorderly conduct. A bench warrant was issued for his arrest but was rescinded later that year, according to records of the Administrative Office of the Pennsylvania Courts. Mayor Ed Fike would not comment. Police Chief Jason Cox could not be reached for comment.
